Findaria Terms of Service
These terms are the agreement between you and Roldan A. Zermeno, of Colima, Colima, Mexico (“we”, “us”), on using the Findaria app. By signing in or continuing to use the app, you accept them. If you don't agree, don't use Findaria.
1. What Findaria is
Findaria is an AI assistant that keeps your documents, payments and things and helps you find them. You write or dictate what you need, and it reads the documents and photos you send, keeps their details, answers you and reminds you of expirations and payments.
2. Your account
- You sign in with your Google or Apple account. You must be at least 18.
- You're responsible for what's done from your account and for keeping access to your phone and to the account you sign in with secure.
- You can create up to 3 sub-accounts (for example, one for your business). They're yours: they depend on your account, share your subscription and your language, and you're responsible for what's done in them. If you delete your account, your sub-accounts are deleted too.
3. Groups and what you share
- You can create or join groups and invite other people with a link.
- What you share with a group is seen by its members. You decide what to share and can stop sharing it. Only share what you have the right to share.
- Each group member needs their own subscription; being in a group doesn't cover anyone else.
4. Subscription
- One plan per person, monthly or yearly, covering everything the app does. The price is the one the App Store shows you before you buy, in your currency and including any applicable taxes.
- Free trial: eligible accounts get 14 days free. Unless you cancel at least 24 hours before it ends, the plan you chose starts and is charged.
- Auto-renewal: the subscription renews automatically at the end of each period, for the same length and at the current price, and is charged to your Apple account within the 24 hours before renewal, unless you cancel at least 24 hours before. If the price goes up, Apple will let you know and, where the law or its rules require it, ask you to agree.
- Cancelling: in your iPhone's Settings (your name → Subscriptions → Findaria). When you cancel, you keep access until the end of the period you've already paid for. Deleting the app or your account doesn't cancel the subscription: cancel it in the App Store.
- Without an active subscription (or trial) you can't use the account: you'll only see the options to subscribe, restore purchases, manage your subscription, sign out and delete your account. Your data is kept, never deleted for not having a subscription, and it's all there again when you subscribe. What you shared with a group stays visible to the group.
- Refunds: Apple handles the charges, so refunds are requested from Apple and follow its rules (reportaproblem.apple.com). If Apple refunds a period, access for that period ends at that moment. We don't give refunds for partial periods, unless the law requires it.
5. Apple and the App Store
If you downloaded Findaria from the App Store, this also applies:
- This agreement is between you and us only, not with Apple. We, not Apple, are responsible for the app and its content.
- You get a limited, non-exclusive, non-transferable license to use Findaria on Apple devices you own or control, as allowed by the Usage Rules in Apple's Media Services Terms and Conditions. Where these terms say nothing, Apple's Licensed Application End User License Agreement (standard EULA) applies.
- Apple has no obligation to provide maintenance or support for the app. For questions, complaints or support, contact us (section 14).
- If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that it fails to meet any legal or regulatory requirement, consumer protection or privacy claims, or claims that it infringes a third party's intellectual property rights; we are responsible for those, to the extent these terms provide.
- You represent that you are not located in a country subject to a U.S. Government embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.
6. Acceptable use
Don't use Findaria to:
- keep or share illegal content, or other people's documents or data without the right to;
- impersonate anyone, forge documents or commit fraud;
- harass other group members or share content with them they don't want;
- try to get into other people's accounts or data, overload or harm the service, extract its code, or get around its limits or the subscription;
- use the assistant in an automated or bulk way, or for anything other than organizing your own documents, payments and things.
7. What the assistant does, and its limits
- The assistant uses AI and can be wrong: misread a number or a date, misunderstand you or give an incomplete answer. Check what it saves and what it tells you before relying on it, especially amounts, dates and expirations.
- Findaria doesn't give legal, tax, financial or medical advice. What the assistant says about procedures, taxes, payments or health is for information only; for important decisions, ask a professional.
- Reminders are a help and may not arrive (for example, if your phone's notifications are off). You remain responsible for your payments, deadlines and procedures.
- Findaria doesn't replace the originals of your documents and isn't an official record.
8. Your data
- What you keep in Findaria is yours. You allow us to store it, read it with the assistant and show it to whoever you share it with, only to provide the service.
- How we process your data, who it's shared with and your rights are in the Privacy Policy.
- You can delete anything from the app, and delete your account and everything you kept from the accounts list: Delete my account and everything, or from this page.
- We do what's reasonable to protect your data and not lose it, but no service is infallible: keep the originals of anything important.
9. The app and its content
Findaria, its name, design and code belong to us or to those who license them to us. These terms give you the right to use the app, not to copy, modify or distribute it. We may change, add or remove features of the app.
10. Suspension and termination
- You can stop using Findaria whenever you want and delete your account. Remember to cancel your subscription in the App Store too.
- We may suspend or close an account that breaks these terms or the law, or that puts the service or other people at risk. Where reasonable, we'll let you know first and give you a chance to download or look at your data.
- If we ever stop offering Findaria, we'll give you reasonable notice.
11. Warranty and liability
- Findaria is provided “as is” and “as available”. It may have errors or interruptions, and we don't guarantee the assistant is always right.
- To the extent the law allows, we're not liable for indirect or consequential damages, such as missed payments or deadlines, fines, late fees, or loss of data or profits, arising from using the app or from what the assistant says.
- To the extent the law allows, our total liability to you is limited to what you paid for Findaria in the 12 months before the event giving rise to it.
- Nothing in these terms limits the rights you have under Mexico's Federal Consumer Protection Law or any other law that can't be waived.
12. Governing law
These terms are governed by the laws of the United Mexican States. Any dispute will be resolved by the competent courts of Colima, Colima, Mexico, without prejudice to your right to go to Mexico's consumer protection agency (Profeco) or to the courts where you live, where the law allows it.
13. Changes to these terms
If these terms change, we'll publish the new version on this page. If the change is significant, the app will ask you to accept it before you continue. If you don't, you can stop using Findaria and delete your account.
